Not necessarily. Most cases can be settled before trial, which is something we seek to do if we can obtain a settlement that is appropriate and fair to our client.
Payments made in personal injury claims are made through the defendant’s insurance policy in almost all cases. This is money the insurance company owes to the injury victim, but would rather avoid paying.
A personal injury lawyer’s job is to convince the insurance company that the weight of evidence in the case indicates that they should pay the claim or it will cost them even more to go to court. We settle about eight out of 10 cases based on strong evidence and our track record of successful litigation.
If we can obtain a proper settlement offer, we will present it to you. Accepting it is your decision, but a settlement ends the case, ensures you are paid quickly and allows you to get on with your life.
If we cannot obtain an acceptable settlement, we will be prepared to fight for you in court and we will make sure you are prepared for court as well.
